It could just be a case of the previous owner hadnt either enough fluid in the forks or hadnt changed the fluid in a while and let the fluid degrade but its worth draining out the forks and replacing the seals. Just to be sure. The forks themselves should be fine unless visibly damaged and out of line in any way but by the sounds of it its just the fluid.
