Hi all

just got my first bike and was looking forward to a days riding. Only one probelem, got to dealers this morning only to find the tax disc hadn't arrive from their other place. They told me its will be OK to ride as if you get stopped the Police can see on their ANPR syetem that the bike's insured and taxed and tell them it's in the post to my house. Just got home to find its not here either, so question is can I ride without the disc on display?

Thanks

Colin

NO, NO, NO, NO, NO and to clarify NO.

The dealer is right in respect that one of the DVLA checks will show the vehicle has tax, if the dealer is being honest and has taxed it.

BUT and its a biggy you can be done for failing to display, that still carries a maximum 4 figure fine i believe. Traffic wardens can call the police to dish those out, ever seen a car parked that has what looks like a red parking ticket? I have seen that with my own eyes although not to my bike.

Actually - its not as severe for bikers as it it for car drivers.

Most police forces are aware that many bikers keep their tax discs under their seats to avoid getting them nicked while parked up. They also know that on some motorcycles there literally is NOWHERE to display a disc, so the courts tend to be a little more lenient.

With ANPR technology the likelihood of you getting a tug for not displaying one is minimal - but it depends on whether or not your bike gets spotted while you are parked up.

And if its in the post it doesnt matter = FAILING TO DISPLAY is an offence in itself.

Its like a small number plate or noisy exhausts, its illegal but it can be overlooked by a generous copper. BUT if you have had a tug then its more than likely the copper, male or female didn't get their oats recently or they may take issue with you just because.

The important point here is its not a 25 quid on the spot or even a 60quid penalty notice. Its a summons and possibly a 4 figure fine. Remember its the TAX man you are taking on here.

That is enough for me to give it a NO vote.

yup failing to display is a new little earner that hey are using more i am told, even if they check and you have paid your tax they still nick you for not displaying it, why they cant give the traffic police/wardens a few bags of tarmac and a shovel too fill some potholes i dont know then at least we could see we are getting something for the millions of tax we give the government, we motorists are the governments cash cow, if everyone stopped buying fuel and using motor vehicles for a week the country would be in dire straits, they would have no money to give to illegals. asylum seekers. clean out duck ponds. rent porno movies, swan up and down the motorway at stupid speeds using loads of fuel in BMW,s etc

Oh no you can't. When you order on-line your supposed to do it in enough time to receive it before the old one expires, after all they allow you to order two weeks before it expires.

Gone are the days when you got two weeks grace because it's "In the post" That doesn't happen anymore.

I think you can get it nearly a month in advance now

merv

You will find that's your MOT certificate Merv, tax is only 15 days. I may be wrong though.

i was told by the (nice)barf.gifbarf.gifbarf.gif tax person on the phone, when i taxed my untaxed car that i could drive it, even though i had no tax disc,as it would show up that i had paid. so their with knobs on.

So why don't the dvla and the government save an absoloute fortune and stop handing out the disks then?

There is only one occasion when you are legally permitted to drive a vehicle without displaying a disc. This is when you have taxed the vehicle on-line, when you are permitted to ride/drive for upto 5 days whilst the disc arrives.

I'm unsure about taking the vehicle to a MOT station. As you can't Tax without an MOT, I would say that it is permitted to travel DIRECTLY between the nearest MOT Station and home for the purposes of obtaining an MOT Test certificate.

The old dealer "it's in the post" story, I'm afraid won't wash with Mr Plod. You could still get nailed for failure to display.

Have you got it in writing?

If not, then that argument ain't worth the line rental it was spoken on.

Failure to display. SLAM.

Regardless of this - There's doubt over the issue. Do you want to risk it, or play it safe and be assured of pleasant riding time?

Wait until you have the damn thing in your hand.

I always go to the local DVLA office itself and walk out with it there and then.

even iff you got SLAMMED with a spot fine you neednt pay it ,as a simple explanaition in wrighting would resolve the matter at the end of the day,and would you realy wait for it to arrive in the post when you know its taxed,(i wouldnt)biggrin.gif .

this really gets my goat!!!

twice in the last year i have bought new bikes (im not rich, the 1st one got written off by a car driver), and in both cases when i have gone to the dealer to pick the machine up there has been no tax.

In each case i have allowed 14 days from putting the deposit down until collection and have sent insurance documents in within 3 days of placing the deposit.

In both cases the dealers made fairly lame excuses, but left me riding a bike home without a disc and without being 100% sure it was road legal. The pain is that you can't really enjoy the bike if the legality of it is unclear and parking on the highway is iffy.

i'd love to know why dealers are so slack about this? both bikes were on 0% finance, i just wonder if it is so the spend out less until the finance company pays them the balance? the cost of the tax is always small compared to the deposit.

either way the feedback the manufacturer gets is sh*t and so it could affect the dealers bonus etc.

This is correct, I phoned the police station over this about 6 months ago, they put me through to traffic who got the book out and told me that its allowed, but you must have an appointment at the MOT station.

Quite simply it is against the law too use a vehicle not displaying a tax disc we all agree, whether it is in the post or not you are not displaying it, they are not doing you for not having the tax they are doing you for not displaying which you cannot deny if the disc is not on the vehicle,if it is taxed and you are waiting for it an enforcment officer with a bit of common sense and some sympathy MAY say ok it is taxed and you have not got the disc, but an anally retentive jumped up little promotion grabbing pillock will just do ya anyhow, the only way you can be safe is to stay off the road, I know of someone who was done on the 2nd of Jan last year at a roadside stop as were several other drivers in the same place same time as her , and they were all just waiting for the disc, but at the end of the day they were breaking a stupid law

You want to take the chance that Royal Fail won't lose it?

Yeah, it could be resolved in writing, but Failure To Display is still a crime.

You get ample notification for when it expires, so you should never be without it. You can drop into a Post Office or DVLA office and get it there and then. Takes an average of 4 minutes, plus queueing time.

But hey - Your choice, peeps.
